HI POINTS FESTIVAL TERMS AND CONDITIONS
Event: Hi Points Festival
Date: September 13, 2025
Location: Denver, Colorado
Producers: Five Points Business Improvement District (501c6) and Conjure Productions Ltd.
1. ACCEPTANCE OF TERMS
By purchasing a ticket, attending, or participating in Hi Points Festival (the "Event"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("Attendee") and the Event producers: Five Points Business Improvement District and Conjure Productions Ltd. (collectively, "Organizers").
2. TICKET PURCHASE AND ADMISSION
2.1 Ticket Validity
Tickets are valid only for the date specified: September 13, 2025
Tickets are non-transferable except through official resale channels
Entry requires valid government-issued photo identification
Ticket holders under 18 must be accompanied by a parent or legal guardian
2.2 Pricing and Fees
All ticket prices are subject to applicable taxes and service fees
Prices may vary based on purchase date and availability
Payment must be made in full at time of purchase
2.3 Refund Policy
All ticket sales are final
No refunds will be provided except as required by law
Event cancellation refunds will be processed within 30 days
Processing fees are non-refundable in all circumstances
3. EVENT POLICIES
3.1 Age Restrictions
The Event is open to all ages
Attendees under 21 will receive different wristbands and cannot purchase alcohol
Children under 12 receive free admission when accompanied by ticketed adult
3.2 Prohibited Items
The following items are strictly prohibited:
Weapons of any kind
Illegal drugs or controlled substances
Outside food and beverages (except sealed water bottles)
Professional cameras or recording equipment
Glass containers
Umbrellas with pointed tips
Backpacks larger than 12" x 12" x 6"
Chairs or blankets
Pets (except service animals)
3.3 Security and Searches
All attendees and bags are subject to search
Metal detectors may be used
Refusal to submit to search will result in denied entry without refund
Security personnel have authority to remove attendees for policy violations
4. HEALTH AND SAFETY
4.1 Attendee Responsibility
Attendees participate at their own risk
Organizers recommend staying hydrated and seeking shade when needed
Medical personnel will be on-site, but attendees are responsible for their own health needs
Attendees with medical conditions should consult physicians before attending
4.2 Weather Conditions
Event will proceed rain or shine unless conditions pose safety risks
Severe weather may result in temporary delays or early closure
No refunds for weather-related inconveniences
4.3 COVID-19 and Health Protocols
Attendees must comply with all applicable health guidelines
Entry may be denied to individuals showing symptoms of illness
Health protocols may change based on current public health guidance
5. CONDUCT AND BEHAVIOR
5.1 Prohibited Conduct
Disorderly, aggressive, or illegal behavior
Harassment of other attendees, staff, or performers
Public intoxication or underage drinking
Attempting to access age-restricted areas without proper identification or wristband
Sharing, transferring, or tampering with age verification wristbands
Providing alcohol to minors or facilitating underage drinking
Smoking in non-designated areas
Littering or property damage
Unauthorized vending or solicitation
5.2 Consequences
Violation of conduct policies may result in:
Immediate removal from the venue without refund
Prohibition from future events
Legal prosecution when applicable
6. LIABILITY AND RISK
6.1 Assumption of Risk
Attendees acknowledge and assume all risks associated with attending the Event, including but not limited to:
Personal injury from crowds, weather, or activities
Loss or damage to personal property
Exposure to loud music and potential hearing damage
Contact with other attendees
6.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Organizers shall not be liable for any indirect, incidental, or consequential damages
Total liability shall not exceed the ticket purchase price
Organizers are not responsible for lost, stolen, or damaged personal property
Attendees participate entirely at their own risk
6.3 Indemnification
Attendees agree to indemnify and hold harmless the Organizers from any claims, damages, or expenses arising from their attendance or conduct at the Event.
7. INTELLECTUAL PROPERTY
7.1 Photography and Recording
Professional photography and video recording are prohibited without written permission
Organizers reserve the right to photograph, film, and record the Event
Attendees consent to being photographed/filmed and grant Organizers unlimited rights to use such images
7.2 Trademarks
"Hi Points Festival" and related marks are property of the Organizers
Unauthorized use of Event trademarks is prohibited
8. FORCE MAJEURE
Organizers shall not be liable for any failure to perform due to circumstances beyond reasonable control, including but not limited to:
Acts of God, natural disasters, or severe weather
Government regulations or public health emergencies
Labor disputes or transportation issues
Acts of terrorism or civil unrest
9. PRIVACY POLICY
9.1 Information Collection
Personal information is collected for ticketing and Event management purposes
Information may be shared with vendors necessary for Event operations
Marketing communications may be sent unless opt-out is requested
9.2 Data Security
Reasonable measures are taken to protect personal information
Payment processing complies with industry security standards
10. COLORADO-SPECIFIC PROVISIONS
10.1 Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
10.2 Venue and Jurisdiction
Any legal disputes shall be resolved exclusively in the state or federal courts located in Denver County, Colorado.
10.3 Colorado Consumer Protection
Nothing in these Terms limits rights provided under the Colorado Consumer Protection Act or other applicable Colorado consumer protection laws.
11. GENERAL PROVISIONS
11.1 Modifications
Event details, including lineup and schedule, are subject to change
Terms may be updated; attendees will be notified of material changes
Continued attendance after changes constitutes acceptance
11.2 Severability
If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force and effect.
11.3 Entire Agreement
These Terms constitute the entire agreement between attendees and Organizers regarding the Event.
